1. Who we are and how to contact us 

1.1 who we are. We are Yute Dreams, a partnership business registered in Australia. Our Australian business number (ABN) is 18654238742. We are not currently registered for tax in Australia, as we are not required to do so under the current laws of the ATO.

2. Placing orders

2.1 How to place an order. All orders are made through our website. Once you’ve added the product(s) you’d like to your basket, you’ll go through our checkout procedure. On the checkout page, you’ll need to enter your contact details, delivery and billing information. Please check, double-check, and even triple-check your order. Some examples of the things to check for are the product(s) you ordered, size(s) and delivery information. Once you are happy with your order, click the “complete order” button or the “pay now” button.

2.2 Acceptance of your order. Your order is an offer from you to us to buy the product(s) in your basket. After you place an order, you will receive an email from us confirming that we have received it. Our official acceptance of your order occurs when we email you to confirm we’ve dispatched your product(s). At this point, a contract will come into existence between you and us. When we acknowledge your order, we’ll also confirm your order number. If you need to contact us about your order, you should quote this number.

2.3 Restrictions on placing orders. To order our products, you must be at least 18 years old and be authorised to use the payment method which you use to pay for the products you order. If you are under 18, you may place an order only with the involvement of a parent or guardian over the age of 18.

 

3 Our rights to cancel your order

3.1  If we cannot fulfil your order. It is unlikely that we won’t be able to fulfil your order. However, sometimes some circumstances may prevent it. Examples may include but not limited to the product being out of stock, we haven’t been able to verify the billing information you’ve provided, you have requested delivery to a country that we do not currently ship to, or there has been an error in the pricing or description of the product), we’ll let you know by email and won’t charge you for the product. Where this occurs, no contract will be formed between you and us.

3.2 Unusual or suspicious activity. We provide our products for your personal use only. We may cancel an order if we notice something unusual or suspect our products are being exploited for commercial, business or re-sale purposes. If this happens to you and you think we’ve made a mistake, get in touch with us by email at support@yutedreams.com.

3.3 Suspending the supply of products. We may have to suspend the supply of a product to you to:

3.3.1 deal with technical problems or make minor technical changes;

3.3.2 update the product to reflect changes in relevant laws and regulatory requirements; and/or

3.3.3 make changes to the product as notified by us to you.

4 Our Products

 

The products we sell

4.1 What we provide. We provide clothing such as T-shirts.

4.2 Descriptions of our products. The pictures of our products (and packaging) on our website are for illustrative purposes only. We work to ensure that colours are displayed accurately, but we can’t guarantee that a device’s display of the colours exactly reflects those of our products.

 

5 Delivery of our Products

5.1 Where we ship to. We currently only shipping to Australia via Australia Post. We hope to ship outside Australia in the next 6 to 12 months.

5.3 Delivery cost. The costs will be as displayed to you on our website prior to checkout.

5.4 Order processing times. Standard shipping within Australia will take approximately 2-8 business days, as express shipping will take approximately 1-4 business days. If your order has not arrived within the allotted time, please contact the shipping company, using the reference number supplied to you.

5.5 Busy periods. Please note that during busy sale periods, you may experience a delay in receiving your order; we apologise in advance for any inconvenience. If you have any questions about your order, don’t hesitate to get in touch with us at support@yutedreams.com.

5.6 If you are not at home when the product is delivered. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery (if possible) or collect the products from a local depot.

 5.7 When you become responsible for the product. The product will be your responsibility once delivered to the address you gave us.

 5.8 When you own products. You own a product once we have received payment in full.

 5.9 Customs duties and taxes. Due to not needing to be registered for GST in Australia, there will be no GST charge at this stage. 

5.10 Delays outside of our control. We are not responsible for delays outside our control. If our supply of products is delayed by an event outside our control, then we will contact you as soon as possible to let you know, and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event.

 

6 Price and payment

6.1 Paying for your order- The price of the order and delivery costs will be in Australian Dollars and will be indicated during the order process. We accept payment for orders by Visa, MasterCard, American Express, Apple pay and Google pay.

 

7. Returns policy

7.1 Returns. If you are not 100% satisfied with your purchase, you can return your products and receive your money back through your original payment method or store credit. This will only happen if you return the item within 14 days of the goods being received. Goods returned must be in perfect original saleable condition with all tags attached.

We do not offer free returns on orders, and you are responsible for any return shipping charges, except for returns of faulty items or items that are described or priced incorrectly. For your protection, please be sure to return your products via recorded or registered post.

In the event of a refund being provided, you will either be refunded via store credit or through the original payment method you provided, depending on what option you choose through our return portal.

7.2 Exchanges. Due to the limited availability of our products, we cannot hold stock for exchanges. If you are not 100% satisfied with your purchase, then you may use our returns policy in accordance with paragraph 7.1 above. If you wish to purchase another item, then you must submit a new order online. Please note that certain items may no longer be available due to our products’ limited production runs.

7.3 What happens if we get the price wrong? It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced on the website. If the product’s correct price at your order date is higher than the price stated, we will contact you and offer you the option to either confirm your order at the correct price or cancel your order. If the correct price at your order date is lower than the price stated, we will refund you the difference.

7.4 Non-refundable items. Due to the risk involved in refunding Gift cards, Gift cards will not be refundable.

9. Our responsibility for loss or damage suffered by you

9.1 Your legal rights. You have certain rights under the law, including the following: Any products you order through this website will be of satisfactory quality, fit for their intended purpose, and will conform to your order and any description given on this website. Nothing in these terms and conditions will affect your legal rights.

9.2 Liability. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

9.3 We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, loss of goodwill, business interruption or loss of business opportunity (and in each of these cases, whether the losses suffered are direct or indirect). This is subject to paragraphs 9.1 and 9.4.

9.4 Loss and damage that is not limited by us. Nothing in these terms and conditions will have the effect of limiting or excluding our liability (i) for death or personal injury caused by our negligence, or (ii) fraudulent misrepresentation, or (iii) any other liability which cannot be excluded or limited under applicable law, such as your legal rights referred to in paragraph 9.1 above.

10.1 Changes to terms and conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

10.2 Governing law. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.
